These Terms and Conditions ("Terms") govern your use of nifmacademy.com and the digital educational courses, materials and services provided by NIFM Academy (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the website or purchase our courses. These Terms incorporate our Privacy Policy (above), which explains how we handle personal data.
 
1. Definitions
  •  "NIFM Academy"/"we"/"us"/"our" – NIFM Academy, based in London, UK.
  •  "You"/"User" – the individual accessing the website, purchasing a course or using the Services.
  •  "Course" – any digital educational content, including videos, PDFs, webinars, assessments and related materials provided through our learning platform.
  •  "Content" – all text, graphics, images, audio, video, software and other materials offered by us.
2. Eligibility
You must be at least 16 years old to use our Services.The Services are intended for users located in the United Kingdom; if you access from elsewhere, you are responsible for compliance with local laws/International Laws.
 
3. Educational purpose & financial disclaimer
The Courses and Content are provided for general educational purposes only. While we aim to help you improve your knowledge of finance, investment, stock?market analysis, accounting and related topics, we do not provide legal, tax or investment advice. Nothing on our website should be interpreted as a recommendation to buy, sell or hold any investment. We are not authorised or regulated by the Financial Conduct Authority, and you acknowledge that you will not rely on our content when making financial decisions. You should obtain independent professional advice before acting on any information.
 
4. Licence and permitted use
4.1 Licence grant. Upon purchasing a Course or accessing free Content, we grant you a non exclusive, non transferable licence to access and use the Content solely for your personal, non commercial learning. You may view the Content on your devices and download permitted materials for your personal use.
4.2 Restrictions. Except as expressly permitted by these Terms or applicable law, you must not:
  • share, sell, resell, rent, sub?license, distribute or reproduce the Content to any third party;
  • modify, adapt, translate, reverse engineer, decompile or create derivative works from any software or Content;
  • remove, obscure or alter any copyright, trademark or other proprietary notices;
  • allow another person to use your account credentials or access the Content;
  • use our Services for any illegal or unauthorised purpose, including to post or transmit harmful, defamatory or infringing material.
4.3 User generated content. If you post comments, assignments or other content to our platform, you retain ownership of your intellectual property. However, you grant NIFM Academy a worldwide, royalty free licence to use, reproduce, display and distribute such content for the purposes of operating and improving our Services. You are responsible for ensuring that any content you provide does not infringe the rights of others or violate the law. We reserve the right to remove content that we consider inappropriate.
 
5. Payment and cancellation
5.1 Payment terms. Course prices are displayed on the website and are payable in the currency stated. We use third party payment processors; by providing payment information you authorise us to charge the applicable fee. Prices may change, but not after you have purchased a Course.
5.2 Cooling off period and digital content. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers buying digital content online usually have a 14 day cooling off period. However, when you purchase a Course, you will be asked to expressly request immediate access to the digital content and acknowledge that this will waive your right to cancel businesscompanion info. Once you access, download or stream the Course materials, you lose your cancellation right and no refund will be available businesscompanion.info. If you do not access the Course within 14 days and you have not opted out of the cooling off period, you may cancel for a refund by contacting us.
5.3 Defective content. If the digital content is defective or not as described, you are entitled to a repair or replacement or, if that fails, a reduction in price or a refund under consumer law. Nothing in these Terms limits your statutory rights.
 
6. Termination and suspension
We may suspend or terminate your access to any Course or Services immediately, without refund, if you breach these Terms (e.g., by sharing content, misusing our platform or providing false information). We may also suspend the Services for maintenance, to address security issues or comply with legal requirements. You may stop using the Services at any time; termination does not relieve you of obligations incurred prior to termination.
 
7. Intellectual property
NIFM Academy and its licensors retain all intellectual property rights in the Services, Courses and Content. You acknowledge that the Content is protected by copyright, trademarks and other laws. Except for the limited licence granted above, no rights are transferred to you. All trademarks, service marks and logos displayed on our website belong to NIFM Academy or their respective owners. You may not use them without prior written consent.
 
8. Disclaimers and limitation of liability
  • The Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error?free or meet your expectations.
  • To the fullest extent permitted by law, NIFM Academy disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
  • We do not guarantee that any information provided through the Services is accurate, complete or up to date. You acknowledge that information about investments, markets or economic conditions may be subject to change and that past performance is not indicative of future results.
  • We are not liable for any loss, whether direct or indirect, arising from your use of the Services or reliance on any Content, except where liability cannot be excluded by law. In any event, our total liability for all claims in connection with the Services will not exceed the amount you paid us for the Course that gave rise to the claim.
  • We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under English law.
9. Indemnity
You agree to indemnify and hold harmless NIFM Academy, its directors, employees and agents from any claims, damages, losses and expenses (including legal fees) arising from your use of the Services, your violation of these Terms or your infringement of any rights of a third party.
 
10. Third party links
Our website may include links to third party websites or resources. Such links are provided for your convenience only. We do not endorse and are not responsible for the content, products or services available from those websites. Your use of third party sites is at your own risk, and you should review their terms and privacy policies.
 
11. Changes to the Services and Terms
We may update the Services, discontinue features or modify Courses at any time. We may also revise these Terms; the current version will always be available on our website. If we make material changes, we will notify you by posting an update or by email. By continuing to use the Services after changes take effect, you agree to the revised Terms. If you do not agree to the changes, you must stop using the Services.
 
12. Governing law and jurisdiction
These Terms and any dispute or claim arising out of them are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any disputes relating to these Terms. Consumers residing in Scotland or Northern Ireland may bring proceedings in their local courts.
 
13. Complaints and alternative dispute resolution
If you have a complaint about our Services, please contact us at Info@nifmacademy.com. We will endeavour to resolve your complaint internally. If you are not satisfied with our response, you may have the right to use the European Commission’s Online Dispute Resolution platform or other alternative dispute resolution schemes. Nothing in this clause prevents you from taking court proceedings.
